The New Law on Parental Leave – A Simple Summary for Employers and Employees

A recent South African High Court ruling declared unequal parental leave unconstitutional. Parliament has two years to amend the Basic Conditions of Employment Act and the UIF Act. Pending Constitutional Court confirmation, all parents, regardless of gender or how their child was born (birth, adoption, or surrogacy), will be entitled to four months of shared parental leave. Single parents will receive the full four months. While the leave is unpaid under the BCEA, UIF benefits may be available. Employers should update leave policies accordingly.
